Licensing policy

PLEASE READ THIS END USER LICENSE AGREEMENT (“EULA”) CAREFULLY. This EULA governs your usage of all modules, themes, associated upgrades, updates, and related services (hereafter the “Product”) provided by mywebpage.rocks under the brand mypresta.rocks. By installing or using the Product, You (“User” or “You”) agree to accept and be bound by both (1) this EULA and (2) any relevant Privacy Policies or Terms of Use found on mypresta.rocks. If You do not accept or agree with these terms, do not install or use the Product.

This EULA coexists with our general Terms and Conditions. Should any provision of this EULA conflict with the general Terms and Conditions, the specific clauses in the Terms and Conditions will prevail.

1. GRANT OF LICENSE

1.1 Non-Exclusive, Non-Transferable License. mypresta.rocks (“we,” “us,” or “our”) grants You a non-exclusive, non-transferable, non-sublicensable, limited right to install and/or use the Product on a single production domain (e.g., example.com), plus its direct subdomain (e.g., dev.example.com) and one additional folder-based instance (e.g., example.com/prestashop/), unless otherwise agreed upon or stated in a special license.

1.2 Domain Usage. This License permits You to use the Product solely on:
• Your primary domain (example.com),
• A directly related subdomain (dev.example.com or stage.example.com),
• A folder installation under the primary domain (example.com/prestashop/).
If You wish to deploy the Product on additional domain(s) or subdomain(s) beyond this scope, You must purchase an appropriate additional License or extension from us.

1.3 Restrictions on Commercial Exploitation. You may not rent, lease, license, sublicense, distribute, or sell the Product or any of its parts for commercial purposes without express written permission from mypresta.rocks.

1.4 Updates, Upgrades & External APIs. Certain parts of the Product may rely on third-party services or APIs that may impose additional terms or costs. You agree to comply with such terms. We do not guarantee uninterrupted compatibility if third-party APIs change or deprecate.

2. PROHIBITED USES

You shall not, directly or indirectly:

  • (i) Reverse engineer, decompile, disassemble, adapt, or create derivative works based on the Product, except to the extent allowed by mandatory law.
  • (ii) Remove, alter, or obscure any proprietary notices, labels, or marks from the Product.
  • (iii) Export or re-export the Product in violation of any applicable laws or regulations.
  • (iv) Engage in any activity that disrupts or harms the Product’s functionality, including transmitting viruses or malicious code.
  • (v) Use the Product in any manner that violates applicable local, national, or international laws or regulations.

3. OWNERSHIP & INTELLECTUAL PROPERTY

All title, ownership rights, and intellectual property rights in and to the Product (including but not limited to code, text, visuals, design elements, documentation) belong to mypresta.rocks or its licensors. The License grants no title or ownership in the Product; it is not a sale of any rights in the Product.

4. WARRANTY DISCLAIMER & LIMITATION OF LIABILITY

4.1 “AS IS” Provision. To the fullest extent permissible under applicable law, the Product is provided “as is” and “as available,” without warranties of any kind (express or implied), including but not limited to fitness for a particular purpose, merchantability, accuracy, or non-infringement.

4.2 No Guarantee of Uninterrupted Use. We do not warrant that the Product will operate without interruptions or be error-free, nor that all defects will be corrected or that the Product will be compatible with future PrestaShop or server environments indefinitely.

4.3 Limitation of Liability. In no event shall mypresta.rocks or its associated service providers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of or inability to use the Product, even if advised of the possibility of such damages. If the Product proves defective, You (and not mypresta.rocks) assume the entire cost of all necessary servicing or repair. Your sole and exclusive remedy in the event of dissatisfaction with the Product is to cease using the Product.

5. TERMINATION

5.1 By You or by Us. This EULA is in effect from the date you first install or use the Product until terminated. You may terminate this EULA at any time by uninstalling the Product and destroying all its copies. We may terminate this EULA if You breach any of its terms or if we decide to discontinue support for the Product.

5.2 Effect of Termination. Upon termination, all licenses granted under this EULA immediately end. You must stop using the Product and destroy or remove all instances of it from your domain, subdomain, or folder installations.

6. CHANGES TO THIS EULA OR THE PRODUCT

6.1 Modifications. We reserve the right to update or modify this EULA for legal, regulatory, security, or best practice reasons. Such changes become effective upon posting the revised EULA on mypresta.rocks or upon other notice to You.

6.2 Your Continued Use. If any future changes to this EULA are unacceptable to You, or cause You to no longer be in compliance, you must terminate use of the Product. Continued use following any update constitutes acceptance of the new terms.

7. PRIVACY & DATA USAGE

We may collect certain data (e.g., license verification, domain details) strictly for license enforcement and support purposes. Any such data handling will comply with our Privacy Policy. By using the Product, You consent to any such data collection and processing necessary for ensuring valid usage of the Product.

9. ENTIRE AGREEMENT

This EULA, along with any other specific terms referenced within, constitutes the entire agreement between You and mypresta.rocks concerning the Product and supersedes all prior or concurrent representations, understandings, or agreements regarding the Product. If any provision of this EULA is held invalid, the remainder shall continue in full force and effect.

By installing, copying, or otherwise using the Product, You acknowledge that You have read and understood this EULA and agree to be bound by its terms and conditions.
